The Court finds that the motion, which lacked any citation to any legal authority or the record, violated D.S.C. Local Civil Rules 7.04 and 7.05, and, in combination with Defendant's failure to reply to Plaintiff's response, failed to meet the burdens imposed on a moving party by Fed. R. Civ. P. 56. However, because the record does not, at this time, support a finding that Defendant filed the motion "for [an] improper purpose, such as to harass, cause unnecessary delay, or needlessly increase the cost of litigation," Fed.
