ORDER and Opinion: The court declines to adopt the part of the Report and Recommendation which recommends denying Defendants summary judgement on the failure to protect claim. The court adopts the remaining portions of the Rep ort. Defendants 49 Motion for Summary Judgment is GRANTED and this action is dismissed. Plaintiffs Claims 4, 5, and 6 are dismissed without prejudice. Plaintiffs failure to protect claim (Claim 1) is dismissed with prejudice.
