Filing 23 ORDER RULING ON 16 REPORT AND RECOMMENDATIONS: The Court adopts that portion of the Magistrate Judge's Report and Recommendation recommending the dismissal with prejudice of plaintiff's claims under the ACAA and un der Title II of the ADA and GRANTS the motion to dismiss with prejudice in regard to the ACCA and the Title II ADA claims. The Court will hold in abeyance a final decision on the motion to dismiss plaintiffs Title III ADA claim to allow plaintiff an opportunity, within fifteen days of this Order, to move to amend her complaint to make a prayer for relief authorized under 42 U.S.C. § 12188(a).
