| Filing 40 TEXT ORDER granting in part and denying in part #39 Motion Plaintiffs Brianna Lynch and Jacob Hyde (collectively "Plaintiffs") have filed a Motion to Equitably Toll Statute of Limitations (ECF No. 39) ("Motion") and an accompanying Memorandum in Support. By way of the instant Motion, Plaintiffs seek to toll the applicable statute of limitations retroactively from the date that they filed their Reply (ECF No. 35) in connection with the pending Motion for Conditional Certification (ECF No. 18) through the end of any notice period that may ultimately be authorized by the Court in ruling upon the Motion for Conditional Certification. The Court has thoroughly reviewed and carefully considered Plaintiffs' Motion and the arguments asserted therein. For specific reasons limited to this case---reasons that will be outlined in the eventual order on Plaintiffs' Motion for Conditional Certification---the Court concludes that equitable tolling is warranted in this instance. See Cruz v. Maypa, 773 F.3d 138, 14647 (4th Cir. 2014) (discussing the standard for equitable tolling); see also Lorenzo v. Prime Commc'ns, L.P., No. 5:12-CV-69-H, 2014 WL 3366073, at *2 (E.D.N.C. July 9, 2014) ("In the interests of justice, courts have allowed equitable tolling of FLSA claims where conditional certification and notice to the prospective plaintiffs has been delayed due to the procedural posture of the case." (collecting cases)). However, the Court will toll the statute of limitations only until the Court issues its ruling on the pending Motion for Conditional Certification.
