ORDER RULING ON REPORT AND RECOMMENDATION: The court affirms the ( 142 in 2:18-cv-00719-TMC-MGB, 135 in 2:19-cv-00572-TMC-MGB, 135 in 2:19-cv-00574-TMC-MGB, 134 in 2:19-cv-00575-TMC-MGB, 136 in 2:19-cv-00576-TMC-MGB) Report and Recommendation as set out. The court DECLINES the Report to the extent it orders SCDC to pay Plaintiffs' reasonable expenses, including attorneys' fees, associated with their motions to compel production. The court DECLINES the magistrate judge's recommendation that Defendants be prohibited from introducing certain video or photos into evidence at trial and that the jury be informed of the Defendants' failure to produce these items. ORDER RULING ON REPORT AND RECOMMENDATION 120 of Magistrate Judge Mary Gordon Baker (130 in 2:19-cv-00574-TMC-MGB, 129 in 2:19-cv-00575-TMC-MGB, 136 in 2:18-cv-00719-TMC-MGB, 130 in 2:19-cv-00572-TMC-MGB, 131 in 2:19-cv-005 76-TMC-MGB). The court ADOPTS the Report of the magistrate judge and incorporates it herein by reference. The court finds that Defendants' motion for partial summary judgment 106 is MOOT to the extent it seeks summary judgment as to Plaintif fs' § 1983 claims against SCDC. In light of Plaintiffs' notice of withdrawal of all § 1983 claims against SCDC, the court hereby DISMISSES those claims. The court DENIES Defendants' motion for partial summary judgment 106 to the extent Defendants request that the court decline to exercise supplemental jurisdiction over the state law claims against SCDC. ORDER that Defendants shall produce to Plaintiffs' Counsel the entire unredacted Roth Report by Monday June 10, 2019. The Roth Report is considered subject to the Confidentiality Order 39 already in place and is for att orneys' eyes only. In addition, the Court finds that, given that Mr. Roth could be a fact witness in this case, Defendants must disclose to Plaintiffs' counsel Mr. Roth's home address so that he may be served a notice of his deposition . ORDER adopting in part 57 Report and Recommendation. Defendants' 24 Summary Judgment Motion is GRANTED in part and DENIED in part. Defendants' motion for summary judgment is granted only as to Plaintiff Jabari Moore's claims brought under 42 U.S.C. § 1983. Accordingly, Plaintiff Moore's federal claims are dismissed without prejudice. Plaintiff Moore's remaining state law claims are REMANDED to the Court of Common Pleas of Lee County, South Carolina. Additionally, the court finds that the remaining Plaintiffs' claims should be SEVERED into separate actions. Plaintiff Battle will continue under the instant civil action number.
