Filing 37 ORDER: For the foregoing reasons, the Court ADOPTS the R & R of the Magistrate Judge (Dkt. No. 36) as the order of the Court. Defendants Motion for Summary Judgment (Dkt. No. 36) is GRANTED in part and DENIED in part. The m otion is GRANTED to the extent that Plaintiffs § 1983 claim is DISMISSED. The motion is DENIED to the extent that Plaintiffs remaining state law claims are REMANDED to state court for disposition. AND IT IS SO ORDERED.
