February 8, 2021	Filing 73 TEXT ORDER: On February 4, 2021, Plaintiff filed a motion for extension of time to respond to Defendants motion for summary judgment based on lack of causation (Dkt. No. 60) pursuant to Rule 6(b)(1)(B) of the Federal Rules of Civil Procedure. (Dkt. No. 70). Defendants have not consented to Plaintiffs motion. (Dkt. Nos. 70-2;70-3). On January 8, 2021, Defendants filed four motions for summary judgment. (Dkt. Nos. 57, 58, 59, 60). On January 18, 2021, Plaintiffs counsel emailed Defense counsel requesting an extension of time for Plaintiff to respond to three of Defendants motions for summary judgment (Dkt. Nos. 57, 58, 59), but the request failed to include Defendants motion for summary judgment based on lack of causation (Dkt. Nos. 60; 70 at 1-2). The parties filed a joint motion for extension of time for Plaintiff to respond to three of Defendants motions for summary judgment (Dkt. Nos. 57, 58, 59, 62). The Court entered a text order extending Plaintiffs time to respond to three of Defendants motions for summary judgment (Dkt. Nos. 57, 58, 59) until February 2, 2021. (Dkt. No. 63). On February 2, 2021, Plaintiff timely responded to three of Defendants motions for summary judgment. (Dkt. Nos. 64, 65, 66, 67). Plaintiff represents that on February 4, 2021, Plaintiffs counsel learned the deadline to respond to Defendants motion for summary judgment based on lack of causation (Dkt. No. 60) passed on January 22, 2021. (Dkt. Nos. 70-2; 70-3). The Court finds that Plaintiffs missing the deadline to respond to Dkt. No. 60 was the result of excusable oversight. Extending the deadline to respond would not prejudice Defendants, would not impact the judicial proceedings or trial of this case, and Plaintiffs counsel has acted in good faith. As such, Plaintiffs motion is GRANTED. (Dkt. No. 70). Plaintiffs deadline to respond to Dkt. No. 60 is on or before February 15, 2021. AND IT IS SO ORDERED.
