For the reasons set forth in this order, the court adopts the reasoning and recommendations of the Report as supplemented and grants Defendants motion to dismiss or for summary judgment (Dkt. No. 31), in part, dismissing Seawright's first and third causes of action and limiting her second cause of action to pursuit of prospective relief based on her alleged speech on fiscal matters. Defendants are all immune from suit save as to the claim asserted against Defendant Byars in his offi cial capacity. Seawright's cross-motions for summary judgment (Dkt. Nos. 40 and 65) and to dismiss Defendants motion (Dkt. No. 44) are denied, including any request to amend her complaint. The matter is remanded to the Magistrate Judge to addr ess the remaining aspects of Byars summary judgment motion. Any requirement for mediation is deferred until after resolution of this motion.
