ORDER choosing not to accept the 56 Report and Recommendation in connection with the § 1983 claim and the SCTCA claim against Forest Acres Police Department. The Court accepts the 56 Report as to the SCTCA claim agai nst Defendant Cooper. Defendant Forest Acres Police Department's 29 Motion for Summary Judgment is denied, and Defendant Robert Cooper's 34 Motion for Summary Judgment is granted in part and denied in part. Specifically, the 34 motion is denied as to the claims pursuant to § 1983, and granted as to the state law claims pursuant to S.C. Code Ann. § 15-78-70. Signed by Chief Judge Terry L.
