Filing 27 TEXT ORDER: As the parties are aware, the court scheduled a hearing on May 11, 2023 to hear argument on Plaintiff South Carolina Freedom Caucus's motion for summary judgment. It has come to the court's attention Defendants believe the hearing will address only the issues of whether discovery is necessary and whether Plaintiff's motion for summary judgment should be denied without prejudice. ECF No. #21 , 2 n.1. To the contrary, the court intends to address the merits of Plaintiff's motion for summary judgment as it does not appear fact discovery would aid in the court's determination of whether S.C. Code Ann. 2-17-10(21) violates the First Amendment. Defendants are granted until April 28, 2023 to file a substantive response to Plaintiff's motion for summary judgment. Plaintiff may file a reply no later than May 5, 2023. The court will hear substantive arguments and take into consideration at that time whether fact discovery will serve to clarify the legal issue at hand.
