April 18, 2023 Opinion or Order Filing 9 TEXT ORDER: On April 12, 2023, Defendant Prisma Health filed a Motion to Stay Scheduling Order, ECF No. #8 , pursuant to Local Rule 16.00(C) and Federal Rule of Civil Procedure 1. Defendant Prisma Health states that it requests a stay of the scheduling order pending resolution of its Motion to Partially Dismiss filed on April 4, 2023. Local Rule 16.00(C) provides that a court may stay the entry of a scheduling order pending the resolution of a motion to dismiss. Here, Defendant Prisma Health has filed a Partial Motion to Dismiss, but Defendant represents that the scope and extent of discovery will be directly affected by the court's determination of the pending Motion, and a ruling on the pending Motion may also limit the issues the parties would need to address moving forward. Defendant argues that in the interest of judicial economy and to avoid potentially unnecessary expenses, the court should grant the stay. Defendant indicates that prior to the filing of the Motion, counsel for parties conferred, however Plaintiff does not consent to the requested relief. ECF No. #8 . Upon review, the undersigned grants the requested relief in ECF No. #8 . The Conference and Scheduling Order, ECF No. #7 , is hereby stayed pending resolution of the Partial Motion to Dismiss filed by Defendant Prisma Health.
