December 4, 2024 Opinion or Order Filing 30 TEXT ORDER: Plaintiff Richard Bernard Moore (Moore) was recently executed by the State of South Carolina. Thereafter, Moore's counsel filed a #29 Notice of Voluntary Dismissal on his behalf. Because Moore has been executed, his claims for declaratory and injunctive relief are now moot. See Bowman v. Corr. Corp. of Am., 350 F.3d 537, 549 (6th Cir. 2003) (holding claims for injunctive relief are rendered moot by a plaintiff's death); Copsey v. Swearingen, 36 F.3d 1336, 1339 n.3 (5th Cir. 1994) (holding claims for injunctive and declaratory relief are rendered moot by a plaintiff's death).
