| Filing 9 TEXT ORDER: In paragraph four of Defendants' Responses to Standing Order Regarding All Removed Cases #8 , one of their bases for thinking "the amount in controversy exceeds $75,000.00" is Plaintiff's failure to "stipulate to the amount of damages to be $75,000 or less." But, this Court has previously held "[a] plaintiff's refusal to stipulate to maximum damages does not establish the claim exceeds $75,000. At best, it provides a tenuous and hypothetical inference." Legg v. Peterbilt of Atlanta, LLC, No. 0:23-cv-4534-MGL, 2024 WL 1679399, at *3 (D.S.C. April 18, 2024) (citation and internal quotation marks omitted). Therefore, not later than November 12, 2024, Defendants shall file a response to this Order showing cause why this case should not be remanded to state court for failure to satisfy the jurisdictional amount requirement.
