December 10, 2010 Opinion or Order Filing 23 ORDER RULING ON REPORT AND RECOMMENDATIONS for 10 Motion for Default Judgment, filed by Joe Hand Promotions Inc. It is hereby ORDERED that the Magistrate Judge's 18 Report is ACCEPTED. For the reasons articulated by the Magistrate Judge, d efault judgment is entered against the Defendants Jimmagan's Inlet, d/b/a Little River Par 5 Sports Bar (f/k/a Varsity Sports Bar), and Steve J. Sheedy, and the defendants are liable for willful violation of 47 U.S.C. § 605. As a result of the violation, the plaintiff is awarded judgment against the defendants in the amount of $17,910.32. This amount includes $15,000 in statutory and enhanced damages pursuant to 47 U.S.C. § 605(e)(3)(C) in addition to $597.19 in costs and $2,313.13 in attorneys' fees pursuant to 47 U.S.C. § 605(e)(3)(B)(iii). October 1, 2010 Opinion or Order Filing 18 REPORT AND RECOMMENDATIONS re 10 MOTION for Default Judgment as to Jimmagan's Inlet, Inc., d/b/a Little River Par 5 Sports Bar (f/k/a Varsity Sports Bar), and Steve J. Sheedy by Joe Hand Promotions Inc. Court recommends default judgment be en tered against Defendants and that they be found liable for willful violation of 47 U.S.C. § 605. As a result of each violation, Joe Hand Promotions, Inc. should be awarded judgment against Jimmagan's and Sheedy, which should include the aw ard of $597.19 in costs and $2,323.31 in attorneys' fees pursuant to 47 U.S.C. § 495(e)(3)(B)(iii) and $15,000 in statutory and enchanced damages pursuant to 47 U.S.C. § 605(e)(3)(C). Thus, the total recommended monetar y award is $17,920.50 ($15,000 damages, plus $2920.50 costs and fees), barring supplementation by counsel. Defendants Jimmagan's and Sheedy should be found jointly and severally responsible for these damages awards. Objections to R&R due by 10/18/2010.
