Filing 55 ORDER. The Court agrees with WFOI that the settlement agreement between Plaintiff and BOAC is discoverable with regard to the issue of set-off. Accordingly, the Court grants WFOI's motion to compel Plaintiff's resp onse to Request No. 5. In fairness to BOAC, who is no longer a party to this suit, the Court directs WFOI to give notice to BOAC's counsel that the agreement is to be produced. BOAC will have five days to file any objections to the production of the settlement agreement. To the extent BOAC and its counsel desire a protective order regarding production of the settlement agreement, he and Plaintiff's counsel should consult and submit a proposed protective order limiting the disclosu re of the BOAC settlement agreement to the parties, counsel, their insurers, or others that they agree upon.
