The order and judgment are modified to provide that the breach of contract and bad faith claims are di smissed without prejudice. The declaratory judgment claim is dismissed with prejudice, as provided in the September 28, 2015 order, and the Court further omits comity as a ground for the dismissal of the declaratory judgment claim.
