September 21, 2017 Opinion or Order Filing 102 OPINION AND ORDER: The Court adopts the 96 recommendation of the Magistrate Judge and hereby incorporates the Report by specific reference to the degree not inconsistent with this Order. It is, therefore, ORDERED that Def endant's Motion for Summary Judgment (ECF No. 40 ) is GRANTED in its entirety. The EEOC's claim that Defendant wrongly terminated Ms. Whitten in violation of the ADA is dismissed and the case is dismissed with prejudice. IT IS SO ORDERED. November 18, 2016 Opinion or Order Filing 81 ORDER granting in part and denying in part 70 Motion for Reconsideration. The Court vacates the portion of its March 31, 2016 Order relating to the EEOC's wrongful termination claim and failure to accommodate claim, ( ECF No.64 at 16-19), and remands this case to the Magistrate Judge for consideration of these claims. Specifically, the Magistrate Judge should address the merits of the wrongful termination claim, with particular attention to the role of the futile gesture doctrine, as well as whether a failure to accommodate claim exists and survives summary judgment. To assist the Court, the parties are directed to submit supplemental briefing on these issues within thirty days from the issuance of this Order.IT IS SO ORDERED. March 31, 2016 Opinion or Order Filing 64 ORDER AND OPINION: After careful consideration of the relevant motions, responses, and objections, the Court adopts the 59 Report and Recommendation in part. It is, therefore, ORDERED that Defendant's Motion for Summar y Judgment (ECF No. 40 ) is GRANTED IN PART and DENIED IN PART. The EEOC's claim that Defendant subjected Whitten to improper medical examinations in violation of the ADA is dismissed with prejudice. However, this case is remanded to the Magistrate Judge for consideration of Defendant's remaining arguments for summary judgment on the EEOC's wrongful termination claim.
