TEXT ORDER: On November 20, 2019, Defendants removed this case to this Court on the basis of federal question jurisdiction. Plaintiff's original complaint alleged state law claims and an employment discrimination and retaliation claim under Title VII, 42 U.S.C. 2000e, et seq. On November 27, 2019, Defendants filed a motion to dismiss under Rule 12(b)(6) of the Federal Rules of Civil Procedure arguing, among other things, that Plaintiff's Title VII employment discrimination and retaliation claims should be dismissed. On December 8, 2019, Plaintiff filed an Amended Complaint and withdrew her Title VII employment discrimination and retaliation claims leaving only state law claims. A review of the Amended Complaint further reveals that there is not complete diversity among the parties. Accordingly, this Court may lack subject-matter jurisdiction. No later than Friday, December 13, 2019, the parties shall either (1) file a joint motion to remand to state court, or (2) brief the Court and SHOW CAUSE why this case should not be remanded to state court for lack of subject-matter jurisdiction.
