TEXT ORDER granting Plaintiff Target Motors, LLC's #10 motion to amend the complaint to remove Manheim Remarketing, Inc. as a party defendant, granting Plaintiff's motion to dismiss without prejudice the eighth cause of action under the Federal Odometer Act, and granting Plaintiff's motion to remand. Plaintiff's motion indicates that counsel for Defendant Manheim Remarketing, Inc. and Defendant Grand Strand Nissan, Inc. consent to the proposed amendment to the complaint and remand of this case to state court. Counsel for Defendant Grainger Companies, Inc. also consents to the dismissal of the cause of action under the Federal Odometer Act and has filed no opposition to the requested remand of this case to state court. As this case was removed to federal court under federal question jurisdiction based solely on the Federal Odometer Act cause of action, which has now been dismissed, this Court finds that remand to state court is appropriate.
