Therefore, it is ORDERED that Jenkin's claim a gainst FCDC is dismissed without prejudice. It is further ORDERED that Jenkin's motion to amend is granted. Plaintiff is granted twenty days from the entry of this order to amend his complaint. Upon receipt of the amended complaint, it is referr ed to the magistrate judge for further proceedings.
