ORDER RULING ON REPORT AND RECOMMENDATION: The court adopts and incorporates the Report and Recommendation (ECF No. 69 ) by reference in this Order. Defendant's motion is denied in part as to the claim for excessive forc e against Defendant in his individual capacity, and granted in part only to the extent Defendant seeks dismissal of claims against him in his official capacity. The court will hold a pretrial conference on February 22, 2017, at 3:00pm. Plaintiff shall appear by video conference. No later than February 13, 2017, both parties shall file a witness and exhibit list. The witness list for Plaintiff shall contain any information Plaintiff has on current location of witnesses he intends to call. IT IS SO ORDERED. ORDER RULING ON REPORT AND RECOMMENDATION: The court adopts the Report and Recommendation 22 and finds Plaintiff's Motion to Dismiss 19 should be granted and Defendant James, Jennings, and Benjamin are dismissed witho ut prejudice. To the extent that Entry No. 27 was intended as a Motion to Amend Plaintiff's Complaint to include as a Defendant the Florence County Detention Center, reference of that motion to the Magistrate Judge is withdrawn, and the motion is denied as it contains no alleged claim against the Detention Center.
