The order explicitly warned Petitioner that failure to do so in the time allotted may result in dismissal of his case. Id. at 1. The proper form order was mailed to Petitioner, (ECF No. 10 ), and has not been returned to the court as undeliverable. Accordingly, Petitioner is presumed to have received the order. However, Petitioner has yet to bring his case into proper form, and the time set forth in the magistrate judge's order has now expired. Accordingly, the case is subject to dismissal for failure to prosecute, pursuant to Federal Rule of Civil Procedure 41(b). Petitioner has 14 days from the date of this order to bring the case into proper form, pursuant to the magistrate judge's order at docket entry #8 . If Petitioner fails to comply with this order, the court will consider Petitioner's claims abandoned and dismiss this action pursuant to Rule 41(b).
