Filing 15 TEXT ORDER: On March 13, 2024, Petitioner filed a Motion for Appointment of Counsel. ECF No. #14 . Petitioner states despite the court's Order indicating Respondent had 50 days from the date of service, Respondent has yet to respond. Petitioner indicates his belief that Respondent will wait until close to the deadline to file a response and ask for an extension, thereby failing to act in the furtherance of justice. See ECF No. #14 . As an initial matter, the court acknowledges the need for the expeditious handling of matters brought before the court. The order to which Petitioner refers, provides Respondent 50 days from the date of service to respond. Respondent's deadline has not yet passed and there is no indication that Respondent intends to seek an extension of time to respond. As to whether the appointment of counsel is warranted in this case at this stage of litigation, although the court has discretion to appoint counsel for an indigent in a civil action, 28 U.S.C. 1915(e)(1); Smith v. Blackledge, 451 F.2d 1201 (4th Cir. 1971), such appointment "should be allowed only in exceptional cases." Cook v. Bounds, 518 F.2d 779, 780 (4th Cir. 1975). The existence of exceptional circumstances "will turn on the quality of two basic factors - the type and complexity of the case, and the abilities of the individuals bringing it." Brock v. City of Richmond, 983 F.2d 1055 (4th Cir. 1993) (unpublished table decision) (quoting Whisenant v. Yaum, 739 F.2d 160, 163 (4th Cir. 1984)). The court has reviewed the allegations in the Petition and does not find this is an exceptional case warranting appointment of counsel at this time. Petitioner's Motion, ECF No. #14 , is denied.
