Filing 4 TEXT ORDER directing the Clerk to open a new civil action with respect to this case. This action was opened as a miscellaneous case. Plaintiff commenced the action by filing a document captioned as an Intent to Sue [Doc. 1] and a motion for leave to proceed in forma pauperis [Doc. 2]. Although Plaintiff's Intent to Sue is not a Complaint, it lists the claims he wishes to bring against Defendants: falsely accused of shoplifting, racial profiling, and malicious prosecution. [Doc. 1.] These claims are all civil causes of action; accordingly, this case should have been opened as a civil action and not a miscellaneous case. Because Defendants are non-state actors, the Court will assume at this stage of the litigation that Plaintiff intends to bring state-law tort claims against Defendants. Accordingly, the Clerk is directed to (1) close the miscellaneous case, (2) open a new civil action using the documents filed in the miscellaneous case, and (3) send the new civil action to the undersigned for further review.
