Filing 11 ORDER The Court adopts the Report and Recommendation as the order of the Court. (Dkt. No. 8). The Court summarily dismisses Plaintiff's claims for declaratory and equitable relief without prejudice and without opportunity to amend. The Court stays Plaintiff's claims for money damages pending the outcome of the state foreclosure proceedings. Plaintiff is directed to file status reports every 180 days from the date of this order concerning the status of the foreclosure proceedings and notify the Court immediately after the state foreclosure proceedings are final. Plaintiff must move to lift the stay within 60 days after the state foreclosure proceedings are final. A failure to provide the Court the required status reports or motion to lift the stay on the schedule set forth herein may subject the damages claims to summary dismissal.
