ORDER: The application sets forth grounds for so proceeding; thus, the Motion to Proceed in forma pauperis [Doc. 4] is GRANTED. Because Plaintiff is an inmate, he is ASSESSED the civil filing fee of $350.00. The Clerk is DIRECTED to file the complaint without prepayment of costs or fees. The Clerk shall not issue process, however, at this time for reasons stated below. For the reasons set forth above, Plaintiff shall have 30 days from the entry of this Order within which to file an amended complaint that sets forth the additional factual detail necessary to state a claim on which relief may be granted. Plaintiff is placed on notice that failure to file an amended complaint as instructed, and which includes the necessary factual support for Plaintiff's claims, will result in this Court recommending to the District Court that Plaintiffs claims be dismissed, because Plaintiff's initial complaint fails to state a claim upon which relief may be granted.
