Filing 39 REMAND ORDER. Pursuant to the Sixth Circuit's instruction, Plaintiffs' "failure-to-train" claims brought under 42 U.S.C. § 1983 are DISMISSED WITH PREJUDICE. Having dismissed Plaintiffs' federal claims prior to trial, the Court declines to exercise supplemental jurisdiction over the state-law claims. The appropriate remedy is to remand the state-law claims back to state court for further review. Accordingly, the remaining state-law claims are REMANDED to the Circuit Court for Campbell County, Tennessee. Signed by District Judge Thomas W Phillips on August 11, 2011. (AYB) |
Filing 36 ORDER STAYING CASE pending resolution of defendants' appeal by the Sixth Circuit. The final pretrial conference scheduled for January 20, 2009, and the trial scheduled for January 26, 2009, are canceled. Signed by District Judge Thomas W Phillips on January 14, 2009. (AYB) |
Filing 34 ORDER granting in part 23 defendants' Motion for Summary Judgment with regard to all claims against defendant Sheriff Gary Perkins and with regard to plaintiffs' allegations that defendants Charles Scott and Ron McClellan inadequately scr eened Mr. Lowe prior to hiring. The motion is denied with regard to all remaining claims and defendants. Plaintiffs may proceed on their claims under 42 U.S.C. § 1983 on a theory of failure to train or supervise, as well as under Tennessee state law. The parties shall prepare the case for trial. Signed by District Judge Thomas W Phillips on December 30, 2008. (AYB) |
