ORDER. Plaintiff, a pretrial detainee confined at the Laurel County Correctional Center in London, Kentucky, has filed a motion #6 seeking to merge Whipple v. Laurel Cnty. Corr. Ctr., 3:21-mc-5 (E.D. Tenn.) into this civil rights action for violation of 42 U.S.C. 1983. Plaintiffs motion [Doc. 6] is DENIED. However, to avoid duplicative litigation, Plaintiff is ADVISED that he may file a voluntary dismissal of the miscellaneous action and seek to amend his complaint in this cause to include the specific allegations of the miscellaneous case.
