To the extent Petitioner intended his #2 affidavit to serve as an application to proceed without payment, the application is DENIED. Petitioner MUST either pay the $5 filing fee or submit a properly supported application to proceed without payment within 28 days of the entry of this Order. Because Petitioner has not demonstrated that the interests of justice require appointment of counsel at this time, his motion for appointment of counsel (Doc. No. #3 ) is DENIED, without prejudice to Petitioner's ability to raise the issue again should circumstances warrant, or the Court's ability to raise the issue sua sponte. Within 28 days of entry of this Order, Petitioner MUST file his habeas petition on a form provided by the Court, in which he must provide the procedural history and factual basis for each claim he asserts.
