OPINION AND ORDER ON MOTION TO DISMISS. The Court orders that the defendants' motion to dismiss is granted as to all of the plaintiffs' causes of action pled in their original petition except for the following causes of action: breach of c ontract, promissory estoppel, negligent misrepresentation, private nuisance, and the DTPA claim. Those causes of action remain pending. All other causes of action asserted in the plaintiffs' original petition are dismissed with prejudice for failure to state a claim upon which relief can be granted.
