ORDER granting in part and denying in part re 9 Defendants' MOTION to Dismiss Amended Complaint filed by Bank of America, N.A. For the reasons stated above, Defendants' motion to dismiss is GRANTED IN PART and DENIED IN PART. The motion to dismiss is GRANTED as to Plaintiffs' claims for violation of the DTPA, as well as for negligent misrepresentation, fraud, unreasonable collection efforts, breach of contract, and estoppel.
