After careful consideration of the motions, response, reply, record, and applicable law, the court, rather than granting Defendant's Motion to Dismiss for Improper Venue, in the interest of justice, transfers this action to the Eastern District of Texas, Sherman Division pursuant to 28 U.S.C. § 1406( a). Accordingly, the court grants Defendant's Motion to Transfer Venue; denies as moot Defendant's Motion to Dismiss for Improper Venue; and declines to rule on Defendant's Motion to Dismiss for Failure to State a Claim, as this motion should be determined by the transferee court.
