Filing 23 Memorandum Opinion and Order re: 7 Defendant's Motion to Dismiss Plaintiff's Complaint for Improper Venue and for Failure to State a Claim or, in the Alternative, to Transfer. After careful consideration of the motions, response, reply, record, and applicable law, the court, rather than granting Defendant's Motion to Dismiss for Improper Venue, in the interest of justice, transfers this action to the Eastern District of Texas, Sherman Division pursuant to 28 U.S.C. § 1406( a). Accordingly, the court grants Defendant's Motion to Transfer Venue; denies as moot Defendant's Motion to Dismiss for Improper Venue; and declines to rule on Defendant's Motion to Dismiss for Failure to State a Claim, as this motion should be determined by the transferee court. (Ordered by Judge Sam A Lindsay on 6/26/2013) (ctf) [Transferred from Texas Northern on 6/27/2013.] |
