September 6, 2016 Opinion or Order Filing 53 MEMORANDUM OPINION AND ORDER - Before the Court are Plaintiff Creswell Holdings LLCs Opening Claim Construction Brief (Dkt. 34 ), Defendant Lenovo (United States) Inc.s Response to Plaintiffs Construction Brief (Dkt. 42 ), and Plaintiffs Reply Clai m Construction Brief (Dkt. 45 ). Also before the Court are the parties March 17, 2016 Joint Claim Construction and Prehearing Statement (Dkt. 33 ) and the parties August 16, 2016 Joint Claim Construction Chart (Dkt. 49 ). The Court held a claim co nstruction hearing on August 30, 2016, to determine the proper construction of the disputed claim terms in United States Patent Nos. 6,194,677 (the 677 Patent), 6,318,695 (the 695 Patent), and 6,340,803 (the 803 Patent). The Court issues this Claim C onstruction Memorandum and Order and hereby incorporates-by-reference the claim construction hearing and transcript as well as the demonstrative slides presented by the parties during the hearing. For the following reasons theCourt provides the const ructions set forth below.The Court adopts the constructions set forth in this opinion for the disputed terms of the patents-in-suit. The parties are ordered that they may not refer, directly or indirectly, to each others claim construction positions in the presence of the jury. Likewise, the parties are ordered to refrain from mentioning any portion of this opinion, other than the actual definitions adopted by the Court, in the presence of the jury.
