MEMORANDUM OPINION AND ORDER re 18 MOTION for Summary Judgment and Judgment on the Pleadings filed by Nationwide Property & Casualty Insurance Company. It is ORDERED that Plaintiff take nothing by its extra-contractual claims of breach of the duty of good faith and fair dealing, violations of the Texas Insurance Code, violations of the Texas Deceptive Trade Practices Act and tie-in statutes, and unfair insurance practices, and that those claims should be DISMISSED with prejudice. Only Plaintiffs breach of contract and prompt payment claims, alleging that Defendant failed to pay Plaintiff the benefits under the Policy to properly repair the Property, should proceed to trial.
