Filing 27 MEMORANDUM AND ORDER. Consistent with the foregoing analysis, the bankruptcy court did not err in finding that the Thaws had the requisite intent to create, allow, or agree to the Schachar Lien and that the fortuity doctrine barred coverage. Accordi ngly, the judgment of the bankruptcy court is AFFIRMED, theTrustee's request for damages for breach of contract and reasonable attorneys fees is DENIED, and the Clerk of Court is directed to close this case.
