Upon review of the entire record, including the briefing submitted regarding applicability of the CISG, the Court makes the following findings: (1) Synergy's "place of business" for the purposes of determini ng if the CISG applies is Colombia; (2) Because Synergy's place of business is Colombia, the CISG applies in this case; (3) Chapter 38.001 of the Texas Civil Practice and Remedies Code is not preempted by the CISG; and (4) Any party prevailing on a breach of contract claim may recover attorneys' fees if it is awarded attorneys' fees by the fact finder.
