MEMORANDUM ADOPTING REPORT AND RECOMMENDATION OF UNITED STATES MAGISTRATE JUDGE for 17 Report and Recommendations. It is, therefore, ORDERED that Defendant Veterans Administration Dallas VA Hospital's 14 Motion to Dismiss for Lack of Su bject Matter Jurisdiction under Rule 12(b)(1) should be GRANTED IN PART and DENIED IN PART. Specifically, Plaintiff's claim challenging the VA's denial of benefits is DISMISSED without prejudice. It is further ORDERED that within fourteen (14) days of the date of this Memorandum, Plaintiff shall file an Amended Complaint regarding her remaining claim under the Federal Tort Claims Act.
