The court finds that since the instant lawsuit is still in the initial screening phase, the Motion (Dkt. #9 ) should be denied. It is therefore ORDERED that Plaintiff's Motion for Hearing (Dkt. #9 ) is hereby DENIED. Should a hearing become necessary, the court will set the case for a hearing at that time.
