ORDER. On this date, the court entered another order #12 directing Plaintiff to file an Amended Complaint. The court finds that since the instant lawsuit is still in the initial screening phase, the Motion (Dkt. #9 ) should be denied. It is therefore ORDERED that Plaintiff's Motion for Hearing (Dkt. #9 ) is hereby DENIED. Should a hearing become necessary, the court will set the case for a hearing at that time. ORDER. It is ORDERED that Plaintiff shall amend his Complaint to specifically allege grounds for jurisdiction. If Plaintiff does not file an amended complaint by Friday, October 27, 2023, or if the amended complaint fails to satisfy the jurisdictional requirements of this court, the court will recommend that the case be dismissed. If Plaintiff no longer asserts that this court has subject matter jurisdiction over his claims, he shall notify the court by Friday, October 27, 2023 so that the court may recommend that his claims be dismissed without prejudice to the refiling of the same in a forum of proper jurisdiction.
