ELECTRONIC Order Transferring to Eastern District of Texas.Plaintiffs Richard Easterday and Angelica Easterday filed this suit against Defendants Equifax Information Services LLC, Experian Information Solutions, Inc., Trans Union LLC, and Toyota Motor Credit Corporation ("Toyota MCC") (collectively, "Defendants") alleging, generally, that Defendants violated the Fair Credit Reporting Act. As alleged in the Complaint, Defendant Toyota MCC has its headquarters in Plano, Texas. Doc. No. 1 at 3. The remaining parties, including Plaintiffs, reside outside of Texas. Id. at 2-3. Plaintiffs allege that venue is proper in the Northern District of Texas because Toyota MCC's "headquarters is located in this judicial district" and "a substantial part of the conduct complained of" and actions giving rise to Plaintiffs' claims occurred in this district. Id. at 4. It is apparent from the Complaint that the only alleged connection to this District is Toyota MCC. However, Plano, Texas is located in Collin County, which is within the Eastern District of Texas, not the Northern District. See 28 U.S.C. 124(c)(3). The Complaint contains no allegations suggesting this civil matter is connected in any way to a county in the Dallas Division of the Northern District of Texas. For the foregoing reasons, the Court finds that the case has a more substantial connection to the Eastern District of Texas. Accordingly, on the Court's own motion, this case is TRANSFERRED to the United States District Court for the Eastern District of Texas, Sherman Division. See 28 U.S.C. 1404(a). ELECTRONIC ORDER:Before the Court is Defendant Toyota Motor Credit Corporation's ("TMCC") Unopposed Motion for Extension of Time to Respond to Complaint (the "Motion") (Doc. No. 10). The Court starts by noting that TMCC fails to cite to the applicable standard for requesting extensions of time or deadline. See Fed. R. Civ. P. 6(b)(1) (court may extend time or deadline "for good cause"). However, the Court, THIS ONE TIME, can and does find good cause for the requested extension of TMCC's responsive pleading deadline. See Fed. R. Civ. P. 6(b)(1)(A). Accordingly, the Court GRANTS the Motion. Defendant TMCC shall answer or otherwise respond to Plaintiffs' Complaint (Doc. No. 1) by August 26, 2026.From the date of this Order, if any party moves for extension of time or deadline without citing to the applicable standard, the Court will summarily deny the motion.
