Filing 8 ORDER ADOPTING 4 Report and Recommendations. While pltf did not file a motion for leave to proceed IFP, such status is DENIED sua sponte. This civil action is DISMISSED with prejudice as to the refiling of another IFP lawsuit raising the same claim s as herein presented, but without prejudice to the refiling of this lawsuit without seeking IFP status and upon payment of a statutory $350.00 filing fee. Pltf's motion for extension of time 6 is GRANTED, and should pltf pay the full fil ing fee within 90 days after the date of entry of final judgment in this case, the lawsuit shall be reopened and he shall be allowed to proceed in the lawsuit as through the full fee had been paid from the outset.
