MEMORANDUM OPINION AND ORDER of Partial Dismission. It is ordered that the Plaintiff may proceed with his excessive use of force claim against Officer Jacob W. Douglas. The Plaintiff's claims against Brad Livingston, Warden Dewberry, Tammy Rai ney, Cheryl Lawson, Tara Patton aka Hatton, and Myra Walker are DISMISSED without prejudice pursuant to FRCP 41(a)(1).
