ORDER ADOPTING REPORT AND RECOMMENDATIONS. ORDERED that the Plaintiff's objections are overruled and the Report of the Magistrate Judge 15 is ADOPTED as the opinion of the District Court. This civil action is DISMISSED with prejudice as frivol ous and for failure to state a claim upon which relief may be granted. The dismissal of this lawsuit shall not prevent the Plaintiff from seeking permission from the Fifth Circuit Court of Appeals to file a successive 2255 motion to vacate or correct his sentence.
