MEMORANDUM ORDER ADOPTING REPORT AND RECOMMENDATIONS. The report of the magistrate judge 37 is ADOPTED as the opinion of the District Court. Plaintiff's claims against the Defendant Bradley Norton are DISMISSED WITHOUT PREJUDICE for failure to effect service of process. The statute of limitations on the Plaintiff's claims against Norton is SUSPENDED for a period of 120 days following the date of entry of final judgment in this case. Should Mitchell discover a current and valid address for Norton within that period of time, he may refile his lawsuit or seek the reopening of the present one.
