MEMORANDUM OPINION AND ORDER Granting in part and Denying in part defts 112 , 116 and 130 12(b)(6) Motions to Dismiss for Failure to State a Claim. It is ORDERED that all claims in the Second Amended Complaint based upon maritime law of the U.S. are dismissed without prejudice and all claims in the Second Amended Complaint based on TX law are dismissed with prejudice. Pltfs are granted leave to file a Third Amended Complaint by 10/8/10, with defts response due 10/20/10. It is further ORDE RED that defts are to file their opening brief on the issue of whether to dismiss the consolidated cases for forum non conveniens no later than 30 days after the Courts ruling on the defts anticipated motion to dismiss the Third Amended Complaint. A s per the Courts order 196 , all consolidated briefing on the issue of forum non conveniens is to be filed in Dominguez vs. Gulf Coast Marine and Associates Inc. et al, case 9:08cv200.
