Failure of any defendant to do so by 5/2/11 will cause the Consolidated Motion for Dismissal for Forum Non Conveniens to be considered waived, and all seven cases will proceed to trial in this Court. MEMORANDUM OPINION AND ORDER Granting in part and Denying in part deftss 25 Rule 12(b)(6) Motion to Dismiss for Failure to State a Claim. It is ORDERED that all claims in the Complaint based upon maritime law of the U.S. are dismissed without prej udice and all claims in the Complaint based on TX law are dismissed with prejudice. Pltfs are granted leave to file an Amended Complaint by 10/8/10, with defts response due 10/20/10. It is further ORDERED that defts are to file their opening brief on the issue of whether to dismiss the consolidated cases for forum non conveniens no later than 30 days after the Courts ruling on the defts anticipated motion to dismiss the Amended Complaint. As per the Courts order 87 , all consolidated briefin g on the issue of forum non conveniens is to be filed in Dominguez vs. Gulf Coast Marine and Associates Inc. et al, case 9:08cv200.
