MEMORANDUM OPINION AND ORDER. Defendants' (Dkt No 225 in 9:08cv200) Consolidated Motion to Dismiss for Forum Non Conveniens is CONDITIONALLY GRANTED. Dismissal of each of the consolidated cases from the Court's docket becomes effective once defendants tender a written statement assenting to be bound by conditions as stated in this order, by 5/2/11. Failure of any defendant to do so by 5/2/11 will cause the Consolidated Motion for Dismissal for Forum Non Conveniens to be considered waived, and all seven cases will proceed to trial in this Court. MEMORANDUM OPINION AND ORDER granting in part and denying in part 26 & 29 Defendants' Rule 12(b)(6) Motion to Dismiss for Failure to State a Claim. The Court ORDERS that all claims in the Complaint based on the maritime law of the United St ates are hereby DISMISSED WITHOUT PREJUDICE. Additionally, all claims in the Complaint based on Texas law are DISMISSED WITH PREJUDICE. The court also denies as moot 48 Plaintiffs' Motion for Leave to Amend Complaint. As required by the Cou rt's order dated September 15, 2010 100 , all consolidated briefing on the forum non conveniens issue shall be filed in Dominguez v. Gulf Coast Marine & Associates, Inc., et al., Case No. 9:08-CV-200. The Court will also hold a hearing on the issue of whether to dismiss the consolidated cases for forum non conveniens on March 10, 2011, at 10:00 a.m. in the United States District Court, 100 E.
