Order Accepting Findings and Recommendations with one exception: the Magistrate Judge failed to address Plaintiff's claims under the Federal Tort Claims Act which this Court addresses in this order. re: 15 Findings and Recommendations on re: 1 Complaint,, filed by Daniel Oriakhi. Plaintiff's federal claims are dismissed with prejudice as frivolous and for failure to state a claim. To the extent Plaintiff has stated any state law claims, this Court declines to exercise sup plemental jurisdiction because the federal claims are dismissed.
