ORDER DISMISSING CASE AS FRIVOLOUS AND ADOPTING REPORT AND RECOMMENDATION. The Court finds that the Magistrate Judge's Report and Recommendation 13 should be ADOPTED and the Plaintiff's complaint 1 should be dismissed with prejudice as frivolous. It is, therefore, ORDERED that: 1) the instant civil rights complaint and all claims alleged therein are DISMISSED with prejudice as frivolous. 2) Any pending motions are DENIED. 3) The dismissal of Plaintiff's complaint does not re lease Plaintiff or the institution where he is incarcerated from the obligation to pay any filing fee previously imposed. 4) Plaintiff is advised that if he appeals this Order, he will be required to pay the appeal fee of $505.00 and submit an application to proceed IFP with a 6-month Certificate of Inmate Trust Account at the time he files his notice of appeal.
