Plaintiff will not be assessed an initial filing fee because he lacks the requisite funds in his prison account to pay an initial fee; however, plaintiff will be required to pay the full filing fee of $350.00 pursuant to the PLRA. ORDER. Plaintiff's complaint is pending judicial screening pursuant to 28 U.S.C. 1915. The Court notes that Plaintiff has not shown any inability to set forth his claims for relief or shown that extraordinary circumstances are involved which would justify the appointment of counsel at this stage of the case. For the reasons set forth herein, #3 Plaintiff's request for appointment of counsel is denied without prejudice to Plaintiff's right to request appointment of counsel should circumstances change.
