Filing 7 JUDGMENT. For the reasons stated in the Court's Order of even date, it is ORDERED, ADJUDGED, AND DECREED that Plaintiff's civil rights complaint is dismissed with prejudice as frivolous pursuant to 28 U.S.C. 1915(e)(2)(B)(i) and (ii). Filing 6 ORDER. For the reasons stated herein, it is ORDERED that (1) Plaintiff's complaint and all claims alleged therein are DISMISSED with prejudice as frivolous or malicious. (2) Plaintiff's Application to Proceed In Forma Pauperis #2 is GRANTED. (3) This dismissal shall count as a qualifying dismissal under 28 U.S.C. 1915 and 1915A, 42 U.S.C. 1997e. Plaintiff is cautioned he has accumulated at least three strikes; therefore, he may not proceed in forma pauperis in any civil action or appeal filed while he is incarcerated or detained in any facility unless he is in imminent danger of serious physical injury. (4) All pending motions are denied. Judgment shall be entered accordingly. Plaintiff is advised that if he appeals this Order, he will be required to pay the appeal fee of $505.00 pursuant to the PLRA, and he must submit an application to proceed in forma pauperis and a 6-month Certificate of Inmate Trust Account at the same time he files his notice of appeal.(Clerk note: TDCJ Inmate Trust Office has been electronically notified (Ordered by Senior Judge Sam R Cummings on 12/4/2018) (jak) |
